Fence Permits in Lee County: What Fort Myers Homeowners Should Know

One of the first questions we get on an estimate is whether a permit is really required. In Lee County — and in Cape Coral, Fort Myers, Collier County, and Charlotte County — the answer is almost always yes for a new fence, and often for a full replacement too.

A permit application typically needs a site plan or survey showing where the fence will sit, the material and height, and the contractor's license and insurance information. Height limits are generally lower in front yards than in back yards, corner lots have visibility triangles you cannot block, and waterfront lots may have additional setback requirements.

Pool safety fencing has its own rules. Florida requires a barrier around residential pools with specific minimum heights, maximum gaps between pickets, and gates that are self-closing and self-latching with the latch mounted out of a child's reach. Inspectors check all of it.

Skipping the permit is a bad trade. Unpermitted fences surface during a home sale or insurance claim, and the county can require you to tear out and rebuild work that doesn't meet code. It also voids most contractor warranties.
